TAG Parent Acknowledgment

Plain-English summary

Tag-a-Tutor matches your child with an older student tutor at your school. We don't run the sessions, we don't supervise them, and we don't choose which students are eligible to be TAG tutors — your school does that. By using TAG you're acknowledging the inherent risks of any tutoring arrangement and agreeing not to hold Tag-a-Tutor responsible for what happens during a session, except where we ourselves have acted with gross negligence or willful misconduct. You stay responsible for deciding whether each match is right for your child and for raising concerns with the school or with us if anything is off. Read the full document below before signing.

1. What this document is

This is an acknowledgment and limited release that you, as a parent or legal guardian, sign before requesting a TAG ("Tutoring Across Grades") tutor through Tag-a-Tutor. TAG is the feature that pairs an older student tutor (typically a high-school student) with a younger student (typically grades K-8) at the same school.

This acknowledgment is in addition to — not a replacement for — the Tag-a-Tutor Terms of Service, Privacy Policy, and Acceptable Use Policy.

2. What Tag-a-Tutor is, and what it is not

Tag-a-Tutor is a matchmaking platform. We provide a website where parents can request tutoring help, and tutors (or facilitators at the parent's school) can respond. Tag-a-Tutor is not:

  • An employer of the tutors. Tutors are students at your child's school, not Tag-a-Tutor employees, agents, or contractors.
  • A supervisor of sessions. Sessions happen offline (typically on school grounds, in a public space designated by the school), with no Tag-a-Tutor staff present, observing, or recording.
  • A background-check service. Tag-a-Tutor does not run criminal-records, abuse-registry, or other background checks on tutors. Eligibility to be a TAG tutor is determined by your school, not by Tag-a-Tutor.
  • A guarantor of outcomes. We make no promise about academic results, behavior, or session quality. Sessions vary, and so do tutors.

3. The school's role

Each school that uses Tag-a-Tutor designates which of its students are eligible to be TAG tutors and is responsible for the policies that govern those sessions, including supervision rules, location requirements, training, and conduct expectations. Tag-a-Tutor relies on the school's designation in good faith; we do not independently vet, train, or evaluate the tutors.

If you have concerns about how your school selects or supervises TAG tutors, you should raise those concerns with the school directly.

4. Inherent risks you acknowledge

You acknowledge that any in-person tutoring arrangement carries inherent risks, including but not limited to:

  • Mismatch in personality, learning style, or communication between the tutor and your child;
  • Instructional errors or sub-optimal teaching;
  • Interpersonal issues that can arise whenever two minors interact, including disagreements, social conflict, hurt feelings, or behavior you disapprove of;
  • Risks associated with travel to and from the session location, and with being on school grounds;
  • The possibility that a tutor's conduct may fall short of what the parent, child, or school would want.

You confirm that you have considered these risks and choose to use TAG anyway.

5. Your responsibilities as the parent

You agree that you, not Tag-a-Tutor, are responsible for:

  • Deciding whether a particular tutor or session is appropriate for your child;
  • Communicating any conditions, accommodations, or supervision arrangements you require to the school and the tutor;
  • Knowing where, when, and with whom your child's TAG sessions take place;
  • Reporting any concern, complaint, or alleged misconduct promptly to your school AND, where appropriate, to Tag-a-Tutor at info@tagatutor.org;
  • Reporting suspected child abuse to the appropriate authorities as required by Texas law (or the law of the state where your school is located).

6. Release of claims (with carve-outs)

To the maximum extent permitted by applicable law, you release, hold harmless, and agree not to sue Tag-a-Tutor, its operator, and its agents (collectively, "Tag-a-Tutor") from and against any and all claims, demands, losses, damages, costs, or expenses arising out of or related to:

  • The conduct of a TAG tutor before, during, or after a tutoring session;
  • The conduct of any other student, parent, or third party encountered through the platform;
  • Decisions made by your school regarding tutor eligibility, supervision, or session policies;
  • The location, transportation to, or physical environment of any TAG session.

This release does not apply to, and you reserve all rights regarding:

  • Tag-a-Tutor's own gross negligence or willful misconduct;
  • Claims that cannot, by law, be released by a parent on behalf of a minor;
  • Claims for fraud or intentional misrepresentation by Tag-a-Tutor;
  • Statutory rights under the Children's Online Privacy Protection Act, FERPA, or other privacy laws.

7. Limitation of liability (read with §6)

To the maximum extent permitted by applicable law, Tag-a-Tutor's total liability to you for any claim that is not released under §6 is limited to the greater of (a) the amount of any fees you have paid to Tag-a-Tutor in the 12 months preceding the claim, or (b) one hundred US dollars (US$100). Tag-a-Tutor will not be liable for indirect, incidental, special, consequential, or punitive damages, regardless of the legal theory.

8. Your authority to sign for the minor

By signing this acknowledgment you confirm that you are the parent or legal guardian of the minor for whom you are requesting tutoring, and that you have the authority to bind that minor to the terms of this acknowledgment to the extent permitted by law.

9. Governing law and disputes

This acknowledgment is governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or related to this acknowledgment will be resolved exclusively in the state or federal courts located in Dallas County, Texas, except where a different forum is required by law (for example, where your school is a public agency in another state).

10. Severability and entire agreement

If any part of this acknowledgment is found to be unenforceable, the rest will remain in effect. This acknowledgment, together with the Tag-a-Tutor Terms of Service, Privacy Policy, and Acceptable Use Policy, is the complete agreement between you and Tag-a-Tutor with respect to the TAG service.

11. Updates

Tag-a-Tutor may update this acknowledgment from time to time. If a material change is made, parents will be asked to review and re-sign before continuing to use TAG.

12. Not legal advice

Tag-a-Tutor is not a law firm and this document is not legal advice. If you have questions about your rights, please consult a lawyer of your own choosing before signing.

How signing works. When you create a parent account or attempt to submit your first TAG request, Tag-a-Tutor will display this document and ask you to (a) confirm you have read it, and (b) type your full legal name. Your acknowledgment is recorded with your email, the name you typed, the time, the IP address you signed from, and the version of this document. You can request a copy of your acknowledgment record at any time by emailing info@tagatutor.org.
